Financial Disclosure in Divorce: Documents, Gaps and Next Steps
Financial disclosure is the process of setting out relevant income, expenditure, assets and liabilities, together with records that support the figures. It helps the parties and their attorneys understand the financial issues in a divorce. Hugh Raichlin Attorneys in Norwood, Johannesburg assists with preparing and assessing that information for settlement discussions and litigation, including interim-relief and accrual issues where relevant.
The initial telephone discussion is free and helps us understand whether the firm can assist. A paid consultation is arranged where appropriate. We aim to respond within one working day after receiving your enquiry.

This page is for you if…
- You have been asked to provide financial information or complete a financial disclosure form.
- You are considering a settlement but cannot understand the figures or supporting records.
- One or both spouses have business interests, variable income, property or retirement benefits.
- You need advice about gaps in disclosure, rather than making an unsupported allegation about concealed assets.
What financial disclosure is meant to answer
Disclosure is not simply a list of bank balances. It should make the relevant financial position understandable: what is owned, what is owed, what income is received, what expenses are being claimed and which records support those statements. The question being decided affects which information matters most. Monthly affordability is different from valuing an estate for an accrual claim, although some records may be relevant to both.
Identifying an asset is not deciding it must be shared
Do not confuse identifying an asset with deciding that it must be shared. Ownership, the matrimonial property system, any relevant agreement and the legal claim still need to be assessed. Similarly, a company bank balance is not automatically the personal bank balance of a spouse who owns shares in that company.
Is there one financial disclosure form for every divorce?
No single online checklist should be treated as the filing specification for every divorce. The court, stage, relief sought, applicable rules, practice directions and any existing order matter. Financial information may be required in an interim application, through discovery in litigation or for informed settlement negotiations. An attorney should check the current requirements before you sign, exchange or file a prescribed document.
For a marriage subject to accrual, section 7 of the Matrimonial Property Act addresses the furnishing of full particulars of estate value when it is necessary to determine accrual. That obligation is not a substitute for checking the procedure and evidence required in the particular proceedings. See the Act in the source list.
Build a record that can be checked
An organised schedule should identify the date and source for each material figure. Mark an estimate as an estimate and explain why the underlying record is unavailable. Record a disputed value as disputed. Do not describe an unknown value as zero merely to complete a spreadsheet.
What to consider before deciding
| Area | Examples of records to identify | Point to clarify |
|---|---|---|
| Income and resources | Payslips, income records, relevant statements and evidence of variable receipts | Is the figure regular income, a once-off receipt, a loan or a transfer between accounts? |
| Expenses and support | A dated expense schedule, invoices and records of payments already made | Which figures are monthly, annual or estimates, and is anything counted twice? |
| Property and debt | Ownership details, purchase records, valuations and loan statements | Who owns the interest, what valuation date is used and what debt is secured against it? |
| Business interests | Shareholding records, agreements, accounts and relevant loan-account information | What belongs to the entity and what right, debt or interest belongs to the spouse? |
| Retirement benefits | Fund name, available member statements and relevant fund correspondence | What benefit is being considered and which dates and documents require further advice? |
| Marital regime and commencement values | Marriage certificate, antenuptial contract and available commencement-value records | Which regime applies and which figures or exclusions need evidence? |
These are examples for a legal discussion, not a demand to obtain every document or a complete court-filing checklist. Only collect and disclose information through lawful, appropriate channels.
| Situation | Practical reconciliation question |
|---|---|
| A receipt into an account | Is it income, a loan repayment or an internal transfer? |
| An annual school or insurance expense | Should it be recorded as a monthly expense without an appropriate explanation? |
| A recent valuation not yet available | Write 'recent valuation not yet available; older statement retained for discussion' rather than selecting a convenient number. |
A useful schedule makes the assumption visible rather than disguising it. Do not alter records, backdate explanations or remove inconvenient entries.
What happens when information is missing or disputed?
First identify the particular gap: the document or transaction, the period it covers, why it matters and what has already been requested. A precise description lets the attorney assess a proportionate next step. The answer may involve clarifying a schedule, requesting supporting information, using an applicable litigation procedure or seeking other relief on appropriate evidence.
Missing information is not automatically proof of fraud, and a suspicion does not itself establish entitlement to a protective order. The available step depends on the proceedings, evidence and applicable law. Tell the attorney about any genuine risk or stated deadline promptly; a website enquiry does not suspend time or confirm urgent representation.
Do not access another person's accounts, devices, passwords or records without lawful authority. Keep records you lawfully hold and ask how further information should be obtained. HRA's general website form is not a secure financial-document repository.
Disclosure, accrual and anti-dissipation are different questions
A disclosure issue asks what information is relevant and how it can properly be supplied or obtained. An accrual issue concerns the legal calculation and evidence applicable to that matrimonial property system. An anti-dissipation issue concerns whether the evidence supports protective relief against conduct that threatens the effectiveness of a claim. One should not be used as a substitute label for another.
Use the related guides for the particular question. HRA's existing anti-dissipation article deals with the protective-relief topic; this page is the preparation and disclosure guide. Do not assume every transfer of money is unlawful or every missing record warrants an application.
Preparing financial disclosure for your matter
Identify the issue
Explain the stage, proposed relief and any papers received.
Organise lawful records
Label sources, dates, estimates and gaps.
Assess the next step
Consider the correct process and the work required.
Prepare the instruction
Confirm the legal scope, fee arrangements and secure channel.
The next steps
- 1Set out the stage of the divorce and the financial issue that needs attention.
- 2Organise the records you lawfully hold and identify the gaps.
- 3Assess the correct process for the missing or disputed information.
- 4Confirm the legal scope, fee arrangements and the appropriate channel for documents.
Information to prepare
A short outline is enough for the initial enquiry. Keep a dated list of the information available, missing records and the questions you need answered. Use the site's preparation resource for an offline checklist; send documents only when the firm confirms the appropriate channel.
- A dated list of income, expenses, assets and liabilities you can lawfully access.
- Notes on which figures are estimates, disputed or still being obtained.
- Marriage certificate, antenuptial contract and commencement-value records where relevant.
- Pension or retirement-fund names and available member statements.
- Any court papers, existing orders or stated deadlines.
Common mistakes to avoid
Avoid treating company turnover as personal wealth, equating incomplete disclosure with proven misconduct, mixing annual and monthly expenses, presenting estimates as established values, or assuming that a generic form meets the requirements of every court.

Can I settle before every financial question is answered?
A proposed settlement should be assessed with the material information and remaining uncertainties in view. Ask what the unresolved questions mean for the terms before deciding whether to sign. A signed agreement is not a replacement for understanding the consequences.
Must I have all the records before contacting HRA?
No. Start with a concise explanation of your matter and the important dates. Explain what you have and what is missing rather than delaying an enquiry or obtaining records improperly.
Is a financial disclosure form the same as an accrual calculation?
No. Disclosure provides relevant information; an accrual calculation applies the relevant legal framework to supported values and any valid exclusions. The documents can overlap without the two tasks becoming interchangeable.
Will this checklist complete my court filing?
No. It is preparation guidance. The correct documents, procedure and filing requirements must be checked for your court and stage of proceedings.

The initial telephone discussion is free and helps the firm assess whether it can assist. Where the firm may be able to help, an attorney ordinarily follows up within one working day after receipt.
- 3
Where appropriate, a paid consultation is arranged. Its scope and fees are confirmed separately; consultations are usually in person, with remote arrangements considered where suitable.
