Living together and building a life does not automatically create a marriage or a joint estate. When a relationship ends, a universal-partnership claim may be relevant, but it depends on an agreement and the parties’ contributions, purpose and conduct. It is not a shortcut to an automatic half share.
Hugh Raichlin Attorneys can assess the family, property and contractual issues together. Start with the assets and outcome in dispute: a house, business interests, savings or an accounting between partners. The legal basis should be identified before anyone promises a percentage.
Separate the different rights you may be discussing
Ownership registered in someone’s name, a partnership interest, a loan, an inheritance claim and maintenance are different questions. One may coexist with another, but evidence of one does not automatically establish the rest. Children’s rights and support must also be considered separately from the adults’ property dispute.
The original Law DotNews article discusses both a universal partnership and succession after a partner’s death. This edition focuses on preparing the partnership assessment. It does not turn the result in that reported dispute into a general inheritance rule for every unmarried couple.
Identify the alleged agreement and its scope
An agreement may be express or inferred from conduct. The assessment considers what each person brought or undertook to bring, whether the arrangement was for their joint benefit, and its material-gain purpose. Contributions can include money, work or skill; a payslip is not the only possible evidence.
Ask which activities and assets the arrangement covered. A particular property venture is not necessarily an agreement to pool everything either person owns. Equally, the absence of a formal partnership deed does not end the enquiry. The whole course of conduct needs a coherent explanation.
Build a record that can be checked
- A relationship and project timeline, including when assets were acquired and when the arrangement changed.
- Bank records, transfer documents, loan agreements and evidence of deposits or instalments.
- Messages, budgets, accounts and statements about shared ownership, profits, work and responsibility.
- Records of unpaid work, management, renovation or other contributions, supported where possible by independent material.
- A list of assets and liabilities, whose names they are in, and any agreement about separating them.
Preserve material that may contradict the claim as well as material that supports it. Distinguish a remembered conversation from a message you can produce. Contributions and benefits should not be counted twice, and a payment description should not be treated as conclusive proof of its legal character.
After a death, do not confuse a claim with estate authority
A survivor’s assertion must be put to the proper estate representative with supporting facts. Being a life partner or a potential claimant does not itself authorise transfers from the deceased’s accounts or distribution of estate property. Wills, nominations and the representative’s appointment need separate attention.
Where assets may be sold or money distributed, explain the actual dates and threatened steps promptly. Preservation relief depends on its own requirements; the seriousness of a disagreement alone does not establish a right to freeze every asset.
Reduce future uncertainty with coordinated documents
A tailored cohabitation or partnership agreement can record ownership, contributions, expenses, liabilities and the process on separation. Coordinate it with valid wills and other relevant arrangements. A new will should not be assumed to rewrite an existing property agreement, and a private agreement should not be assumed to bind a bank or other outsider.
Does a long relationship guarantee a partnership claim?
No. Duration is part of the context, but the agreement, contributions and purpose must still be established. Living together for a particular number of years does not automatically convert the relationship into marriage.
Must contributions always be equal?
Not necessarily. The nature and scope of the proven arrangement matter. Avoid starting with an assumed equal division and selecting only the records that support it.
Discuss the evidence before choosing the remedy
Prepare a short account of the relationship, the assets in dispute and any immediate step by the other party or an executor. HRA can identify the relevant documents and whether negotiation, mediation or proceedings are appropriate. Keep sensitive financial records for the channel the firm requests, rather than posting them in an initial website enquiry.
