Maintenance after a life partnership ends: what must your claim actually establish?

After an unmarried relationship ends, a claim for personal support requires a clear legal basis. It should not be treated as an automatic copy of spousal maintenance in divorce. Child maintenance, ownership disputes and a former partner’s personal claim must also be kept separate, even when they arise from the same household.

Hugh Raichlin Attorneys can assess the relationship, the evidence of support arrangements and the remedy being sought. The length of cohabitation is part of the facts, not a substitute for analysing the claim. An initial discussion helps identify whether the firm can assist and what documents a consultation will need.

The source case concerned interim relief, not every possible claim

The original article discussed an unsuccessful interim maintenance application while the main action between former life partners was still pending. The court required proof of the facts said to establish the relevant duty of support and limited its conclusions to the application before it.

That distinction matters. A refusal of interim relief does not automatically decide every ownership, contractual or support claim in the eventual case. Conversely, an allegation of reciprocal support does not establish an immediate entitlement to the amount demanded. The legal basis, evidence and procedure all require attention.

Explain the agreement and the way the household worked

A useful record sets out what the parties agreed, what each contributed and what changed. Include any cohabitation agreement, later written arrangement, correspondence about financial commitments and records showing how those commitments were implemented.

Explain periods of financial dependency, childcare and other work, as well as changes in employment, health or living arrangements. Distinguish an express promise from an assumption about what the other person would always provide. Advice will need to assess both the facts supporting the claim and the likely response.

Separate four different questions

  • What support is required for the children and what orders already exist?
  • What personal support is being claimed by the former partner, on what legal basis?
  • Who owns particular property, accounts or business interests?
  • Is temporary relief sought now, or final relief in a substantive case?

Claims arising after separation must not be confused with rights that may arise when a life partner dies. The applicable legislation and constitutional developments differ by context. Neither an old article nor a generic statement that partners have no rights supplies a complete answer across all four questions.

Prepare for the immediate decision without overstating it

If temporary relief is being considered, provide a realistic budget, current income, available resources, existing support and the procedural position of the main dispute. Identify the date by which a particular expense must be met and why the matter cannot be dealt with through the ordinary process.

Do not label a matter urgent merely because separation is distressing. Equally, do not wait until a deadline has passed to explain that a hearing or required response is approaching. The firm’s ordinary follow-up target is not a promise of same-day proceedings.

Questions clients ask

Does living together for a number of years guarantee maintenance?

No fixed period should be treated as an automatic answer. The relationship, undertakings, law and specific remedy need to be established.

Can I stop child maintenance while my personal claim is disputed?

Do not use the child’s support as leverage. Existing obligations and orders require their own treatment, and the child’s claim is separate from the adults’ personal financial dispute.

Will a cohabitation agreement prevent every disagreement?

No document can guarantee that. A properly considered agreement can clarify responsibilities and consequences, but its terms, validity and application still matter when circumstances change.

A useful first consultation starts with the evidence

Prepare a short relationship timeline, the key agreements, financial records, existing orders and the relief you are seeking. That allows the attorney to assess a workable route instead of beginning with an assumed equivalence between cohabitation, marriage and every form of maintenance.
